9. PATIENT HEALTH INFORMATION
The privacy and security of Patients’ individually identifiable health information provided to eVisit in connection with Services may be protected by federal law (HIPAA, Nigeria Data Protection Act (NDPA) 2023 , and their regulations) and state privacy laws, because Fastcare provides services to health care providers and patients. This health information is “protected health information” (“PHI”). PHI may be used and disclosed by Fastcare as necessary to provide services, for our own management and operations, to meet our legal obligations, and for any other purpose for which patients have given consent. We may share PHI with third parties for these purposes in compliance with applicable law. We may de-identify PHI and aggregate it for purposes of monitoring and improving our products and services, for benchmarking purposes, and to provide customized services or technologies to our customers.

You can request access to the data we hold about you. A small fee may apply to cover admin costs.

Fastcare recognizes the importance of protecting the privacy of those who visit and choose to use the services. With respect to all the personal information belonging to, and/or processed in connection with Fastcare, the mobile application or website, such personal information at all times are in compliance with the necessary data protection law in the territory, in all respect and in particular the Nigeria Data Protection Act 2023 and all applicable data protection law in force. By using Fastcare, you consent to such processing and you commit to provide accurate information.
12. Breach/Privacy Violation
In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal information, Fastcare shall within a reasonable time of having knowledge of such breach report the details of the breach to the Nigeria Data Protection Commission (NDPC) at ndpc.gov.ng or the applicable data protection authority in your jurisdiction.Furthermore, where we ascertain that such breach is detrimental to your rights and freedoms in relation to your personal information, we shall upon having knowledge of the occurrence of such breach take steps to inform you of the breach incident, the risk to your rights and freedoms resulting from such breach and any course of action to remedy the said breach.
